Terms of Service
Please read these Terms of Service carefully before using the Mailbux platform. By accessing or using our Service, you agree to be bound by these Terms.

1. Acceptance of Terms
By creating an account, accessing, or using any services provided by Mailbux.com, operated by Mailbux ("Company," "we," "us," or "our"), you ("User," "you," or "your") acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service ("Terms"), together with our Privacy Policy, which is incorporated herein by reference.
If you are using the Service on behalf of a business, organization, or other entity, you represent and warrant that you have the authority to bind that entity to these Terms, and "you" shall refer to that entity.
If you do not agree to all of these Terms, you must not access or use the Service. Your continued use of the Service following any changes to these Terms constitutes your acceptance of those changes.
2. Eligibility
You must be at least eighteen (18) years of age, or the age of legal majority in your jurisdiction, to create an account and use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding agreement.
The Service is not directed to individuals under the age of eighteen (18). If we become aware that a User is under the age of eighteen (18), we will terminate that account immediately.
3. Description of Service
Mailbux is a business email hosting platform that enables users to create and manage professional email accounts on their own custom domains. The Service includes, but is not limited to:
- Custom domain email hosting with full DNS configuration support
- Browser-based webmail access
- Support for IMAP, POP3, SMTP, and JMAP protocols for desktop and mobile email clients
- Integrated calendar, contacts, and file storage (where available)
- Administrative dashboard for account and domain management
- API access for programmatic account management
- Reseller and white-label capabilities (subject to additional terms)
- Addon products and premium plan upgrades
The Company reserves the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice, and without liability to you.
4. Account Registration and Security
To use the Service, you must create an account and provide accurate, complete, and current information during the registration process. You agree to update your information promptly if it changes.
You are solely responsible for:
- Maintaining the confidentiality of your account credentials, including your password
- All activities that occur under your account, whether or not authorized by you
- Notifying us immediately at [email protected] if you become aware of any unauthorized access to or use of your account
The Company shall not be liable for any loss or damage arising from your failure to maintain the security of your account credentials. We reserve the right to disable any account at any time if, in our sole judgment, you have violated any provision of these Terms.
You may not create multiple free accounts for the purpose of circumventing service limits, and doing so may result in the termination of all associated accounts without notice.
5. Subscription Plans and Fees
The Service offers both free and paid subscription plans. Each plan provides specific features, storage allocations, and account limits as described on our pricing page at the time of purchase.
- Free Plan: Subject to limitations on storage, mailboxes, and features. The Free Plan may be modified, reduced, or discontinued at any time at the Company's sole discretion.
- Paid Plans: Offer additional storage, mailboxes, features, and priority support. Paid Plans are billed on a recurring basis (monthly or annually) as selected at the time of purchase.
- Addon Products: Additional features or services (such as webmail rebranding, reseller tools, or premium applications) may be purchased separately and are subject to their own pricing and terms.
The Company reserves the right to change pricing for any plan or addon at any time. Price changes for existing paid subscriptions will take effect at the start of the next billing cycle following notice to you.
6. Payment Terms and Billing
All paid subscriptions are processed through our third-party payment processor, Stripe. By subscribing to a paid plan, you agree to Stripe's terms and authorize us to charge your designated payment method on a recurring basis.
- Automatic Renewal: Paid subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date.
- Failed Payments: If a payment fails, we may retry the charge, suspend your access to paid features, or downgrade your account to the Free Plan. We are not obligated to provide notice before taking such action.
- Taxes: All fees are exclusive of applicable taxes, levies, or duties. You are responsible for paying all such taxes associated with your use of the Service.
- Currency: All prices are listed in United States Dollars (USD) unless otherwise stated.
7. No Refund Policy
All payments made to Mailbux are final and non-refundable.
This includes, without limitation, monthly and annual subscription fees, addon product purchases, plan upgrades or downgrades (unused portions of a billing cycle are not refunded), and payments for accounts that are subsequently suspended or terminated for violation of these Terms.
By subscribing to a paid plan, you acknowledge and agree that no refunds will be issued under any circumstances, including but not limited to dissatisfaction with the Service, accidental purchases, failure to cancel before a renewal date, or account termination due to policy violations.
If you wish to cancel your subscription, you may do so at any time through your account dashboard. Cancellation will take effect at the end of your current billing period, and you will retain access to paid features until that date.
8. Free Plan
The Free Plan is provided as a courtesy and may be modified, limited, or discontinued at any time without prior notice. The Company makes no guarantees regarding the availability, features, storage limits, or performance of the Free Plan.
Free Plan accounts that remain inactive (no login or email activity) for a period of ninety (90) consecutive days may be automatically suspended or deleted, including all associated data, without notice.
The Company reserves the right to impose additional restrictions on Free Plan accounts, including but not limited to rate limiting, reduced storage, or limited sending capabilities, at any time.
9. Acceptable Use Policy
You agree to use the Service only for lawful purposes and in accordance with these Terms. You are solely responsible for all content sent, received, stored, or otherwise transmitted through your account.
You agree that you will not use the Service to:
- Send unsolicited bulk email (spam), including commercial, promotional, or marketing messages to recipients who have not explicitly opted in
- Send, distribute, or store material that is obscene, threatening, defamatory, or otherwise unlawful
- Engage in phishing, spoofing, or any form of fraudulent communication
- Distribute viruses, malware, ransomware, trojans, worms, or any other malicious code
- Harvest, collect, or store personal data of third parties without their consent
- Impersonate any person, business, or entity, or falsely represent your affiliation with any person or entity
- Interfere with or disrupt the integrity or performance of the Service or its underlying infrastructure
- Attempt to gain unauthorized access to the Service, other accounts, computer systems, or networks connected to the Service
- Use the Service in connection with any illegal activity, including but not limited to fraud, money laundering, terrorist financing, or the distribution of illegal substances
- Resell, redistribute, or sublicense the Service without authorization
- Use the Service to operate open mail relays or open proxies
- Engage in any activity that violates the CAN-SPAM Act, GDPR, CASL, or any other applicable anti-spam or data protection legislation
10. Prohibited Activities
In addition to the restrictions outlined in the Acceptable Use Policy, the following activities are strictly prohibited and constitute grounds for immediate account termination without notice or refund:
- Spam and Bulk Email: Sending unsolicited messages in bulk, regardless of content type. This includes email lists purchased from third parties, scraped addresses, or any list where recipients have not provided explicit opt-in consent.
- Email Bombing: Sending an excessive number of emails to a single recipient or domain with the intent to disrupt or overwhelm.
- Abuse of Resources: Using the Service in a manner that consumes disproportionate resources, including CPU, bandwidth, storage, or connections, relative to your plan, or in a manner that degrades the service for other users.
- Automated Account Creation: Using bots, scripts, or automated tools to create accounts, send emails, or interact with the Service without prior written authorization.
- Circumvention: Attempting to bypass, disable, or circumvent any security measures, rate limits, quota restrictions, or access controls implemented by the Service.
- Reverse Engineering: Decompiling, reverse engineering, disassembling, or otherwise attempting to derive the source code of the Service or any component thereof.
- Network Abuse: Engaging in any activity that could damage, disable, or impair the Service's servers, networks, or connected systems, including denial-of-service attacks.
- Trademark Infringement: Using the Service to send emails that infringe upon the trademarks, service marks, or trade names of any third party.
11. Email Content and Conduct
You are solely responsible for all content that you send, receive, or store using the Service. The Company does not monitor email content as a matter of course, but reserves the right to review content when required by law, when investigating potential violations of these Terms, or to protect the safety and security of our users and infrastructure.
The Company may, in its sole discretion, remove or refuse to deliver any email that violates these Terms or that we reasonably believe may expose us to legal liability. We are not obligated to provide prior notice before taking such action.
You acknowledge that email communication is not inherently secure. The Company is not responsible for any unauthorized interception of your emails by third parties.
12. Storage and Service Limits
Each subscription plan includes specific storage allocations, mailbox limits, domain limits, and sending quotas as described on our pricing page. These limits are subject to change at any time.
- If your account exceeds its allocated storage, you may be unable to send or receive new emails until storage is reduced or your plan is upgraded.
- The Company reserves the right to enforce sending rate limits, attachment size limits, and other operational restrictions to maintain the quality and reliability of the Service for all users.
- We are not responsible for any data loss resulting from exceeding your plan's storage allocation or from account inactivity.
Data Retention
Upon account termination or deletion, all data associated with your account — including emails, attachments, contacts, and calendar entries — will be permanently deleted. The Company is under no obligation to retain, forward, or provide access to your data after account termination.
13. Domain Management
You may connect your own custom domains to the Service for email hosting. By adding a domain, you represent and warrant that:
- You own the domain or have been duly authorized by the domain owner to use it with the Service
- The domain is not being used for any unlawful purpose
- You will configure the required DNS records (MX, SPF, DKIM, DMARC) as instructed by the Service
The Company is not responsible for DNS propagation delays, domain registration issues, or any conflicts arising from your domain configuration. If a domain is found to be associated with abuse, spam, or other violations of these Terms, the Company may remove the domain and suspend the associated account without notice.
14. Reseller and White-Label Terms
Users who subscribe to reseller or white-label addon products may provide email hosting services to their own end-users ("Sub-Users") under their own brand. Resellers agree to the following additional terms:
- Resellers are fully responsible for the actions and conduct of their Sub-Users. Any violation of these Terms by a Sub-User will be treated as a violation by the Reseller.
- Resellers must maintain their own terms of service and acceptable use policies for Sub-Users that are at least as restrictive as these Terms.
- The Company may suspend or terminate a Reseller's account and all associated Sub-User accounts if the Reseller or any Sub-User violates these Terms.
- Resellers are solely responsible for providing first-level support to their Sub-Users. The Company's support team will only communicate with the Reseller account holder.
- The Reseller's subscription fees cover the infrastructure and platform. Pricing to Sub-Users is at the Reseller's sole discretion.
15. Intellectual Property
The Service, including all software, interfaces, designs, logos, trademarks, documentation, and other intellectual property, is and shall remain the exclusive property of the Company. These Terms do not grant you any right, title, or interest in the Service beyond the limited right to use it in accordance with these Terms.
You retain ownership of all content that you create, send, or store using the Service. By using the Service, you grant the Company a limited, non-exclusive license to process, store, and transmit your content solely for the purpose of providing the Service to you.
The Mailbux name, logo, and all related trademarks are the property of the Company. You may not use our trademarks without prior written consent, except as expressly permitted under the white-label addon product.
16. Privacy and Data Protection
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your personal information. By using the Service, you consent to the practices described in the Privacy Policy.
We implement commercially reasonable technical and organizational measures to protect the security and confidentiality of your data. However, no method of transmission over the internet or electronic storage is 100% secure, and we cannot guarantee absolute security.
You are responsible for ensuring that your use of the Service complies with all applicable data protection laws and regulations, including the General Data Protection Regulation (GDPR) where applicable.
17. Account Suspension and Termination
Termination by You: You may cancel your account at any time through your account dashboard or by contacting [email protected]. Cancellation of a paid subscription will take effect at the end of the current billing period.
Termination or Suspension by the Company: We reserve the right, in our sole and absolute discretion, to suspend, restrict, or terminate your account and access to the Service, in whole or in part, at any time, for any reason or for no reason, with or without prior notice, and without any liability to you. Reasons for suspension or termination may include, but are not limited to:
- Violation of these Terms or any applicable law or regulation
- Engaging in or facilitating spam, phishing, abuse, or other prohibited activities
- Non-payment or repeated payment failures
- Account inactivity for an extended period
- Requests from law enforcement or government agencies
- Conduct that we determine, in our sole discretion, may expose the Company, our users, or any third party to legal liability or harm
- Actions that threaten the security, integrity, or availability of the Service or its infrastructure
- Discontinuation or material modification of the Service
Effect of Termination
Upon termination, your right to access the Service ceases immediately. All data associated with your account, including emails, contacts, domains, and files, may be permanently deleted without any obligation to provide a copy or backup. No refund, credit, or compensation of any kind will be provided upon termination for any reason.
Survival: Sections relating to intellectual property, limitation of liability, indemnification, no refund policy, governing law, and any other provisions that by their nature should survive termination, shall survive the termination or expiration of these Terms.
18. Service Availability
The Company strives to maintain high availability of the Service but does not guarantee uninterrupted, timely, or error-free operation. The Service may be subject to scheduled maintenance, unplanned outages, or interruptions beyond our control.
We shall not be liable for any downtime, data loss, delayed delivery, or non-delivery of emails arising from service interruptions, regardless of cause. The Company does not offer service level agreements (SLAs) unless separately agreed upon in writing.
The Company shall not be liable for any failure to perform its obligations under these Terms where such failure results from events beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, government actions, power failures, internet or telecommunications failures, or attacks on our infrastructure (including DDoS attacks).
19. Disclaimer of Warranties
- Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
- Warranties that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components
- Warranties regarding the accuracy, reliability, or completeness of any content or information provided through the Service
- Warranties that the Service will meet your specific requirements or expectations
20. Limitation of Liability
- Loss of profits, revenue, data, goodwill, or business opportunity
- Cost of procurement of substitute goods or services
- Damage to reputation or loss of customers
- Any unauthorized access to, alteration of, or deletion of your data or transmissions
- Service interruptions, delays, or failures
These limitations apply regardless of the theory of liability (whether in contract, tort, negligence, strict liability, or otherwise) and even if the Company has been advised of the possibility of such damages.
21. Indemnification
You agree to indemnify, defend, and hold harmless the Company, its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or relating to:
- Your use or misuse of the Service
- Your violation of these Terms or any applicable law, regulation, or third-party right
- Any content you send, receive, or store using the Service
- Any dispute between you and a third party relating to your use of the Service
- Your negligence or willful misconduct
This indemnification obligation shall survive the termination of your account and these Terms.
22. Third-Party Services
The Service may integrate with or contain links to third-party websites, services, or applications, including but not limited to payment processors (Stripe), DNS providers, and email clients. The Company is not responsible for the content, terms, privacy practices, or functionality of any third-party services.
Your use of third-party services is governed by their respective terms and policies. The Company makes no representations or warranties regarding any third-party service and shall not be liable for any loss or damage arising from your use of such services.
23. Modifications to Terms
The Company reserves the right to modify, amend, or replace these Terms at any time at its sole discretion. When we make material changes, we will update the "Effective Date" at the top of this page and may, at our discretion, provide additional notice through the Service or via email.
It is your responsibility to review these Terms periodically for changes. Your continued use of the Service after any modifications to these Terms constitutes your acceptance of the updated Terms. If you do not agree with the modified Terms, your sole remedy is to discontinue your use of the Service and close your account.
24. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Company is incorporated, without regard to its conflict of law principles.
Any dispute arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in the Company's jurisdiction of incorporation. You consent to the personal jurisdiction of such courts and waive any objection to the exercise of jurisdiction over you by such courts.
You agree that any cause of action arising out of or related to the Service must be commenced within one (1) year after the cause of action accrues. Otherwise, such cause of action is permanently barred.
25. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, shall be severed from these Terms. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect.
26. Entire Agreement
These Terms, together with the Privacy Policy and any additional terms or policies referenced herein, constitute the entire agreement between you and the Company with respect to your use of the Service. These Terms supersede all prior or contemporaneous agreements, communications, proposals, and representations, whether oral or written, relating to the Service.
No waiver of any provision of these Terms by the Company shall be deemed a further or continuing waiver of such provision or any other provision. The Company's failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
